Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at govitamins.app, the Go Vitamins web application, and any related services (collectively, the "Service"), operated by OpenAir LLC, doing business as Go Vitamins ("Go Vitamins," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.


1. Important - Medical Disclaimer

PLEASE READ THIS SECTION CAREFULLY. IT LIMITS OUR LIABILITY AND DESCRIBES THE NATURE OF THE SERVICE.

Go Vitamins is an educational and informational tool. It is not a medical device, not a substitute for professional medical advice, diagnosis, or treatment, and not a substitute for personalized care from a licensed pediatrician, registered dietitian, allergist, or other qualified healthcare professional.

  • The Service does not diagnose, treat, cure, or prevent any disease or medical condition.
  • Information provided by the Service - including AI-generated guidance, nutrient scores, recommended foods, swap suggestions, and "child acceptance" predictions - is general educational content based on public sources such as the American Academy of Pediatrics (AAP) guidelines and peer-reviewed nutrition research. It is not individualized medical advice.
  • AI features can make mistakes. Always verify allergen information, ingredient lists, and serving sizes by reading product packaging directly.
  • Always consult your child's pediatrician or a qualified healthcare professional before making significant changes to your child's diet, especially if your child has a medical condition, food allergy, intolerance, or developmental concern.
  • In a medical emergency, including suspected allergic reactions or choking, call 911 (or your local emergency number) immediately. Do not rely on the Service.

By using the Service, you acknowledge that you understand and accept these limitations, and that you assume full responsibility for any decisions you make based on information provided by the Service.


2. Eligibility

To use the Service you must:

  • Be at least 18 years of age.
  • Be a parent or legal guardian of any child whose information you enter into the Service, or have explicit authorization from such a parent or guardian.
  • Not be prohibited from using the Service under U.S. law or the laws of your jurisdiction.

Children may not create accounts or use the Service directly. See Section 11 for our children's privacy framework.


3. Your Account

When you create an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain the confidentiality of your password.
  • Be responsible for all activity that occurs under your account.
  • Notify us immediately at info@govitamins.app if you suspect unauthorized access.

We may suspend or terminate your account if you violate these Terms or if we reasonably believe your conduct poses a risk to other users, our team, or the Service.


4. Subscriptions, Trial, and Payments

4.1 Free Trial

We offer a 7-day free trial of paid features for new accounts. You may be required to provide payment information to start the trial. If you do not cancel before the trial ends, your paid subscription will begin automatically and the applicable subscription fee will be charged.

4.2 Subscription Plans

We currently offer:

  • Solo (1 child): $9.99 / month (USD) or $39.99 / year (USD)
  • Family (2+ children): $14.99 / month (USD) or $59.99 / year (USD)

Prices are exclusive of applicable taxes. We may change prices on prospective billing periods with notice; price changes will not apply to your current billing cycle.

4.3 Auto-Renewal

Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current rate, unless you cancel before the renewal date. You can cancel anytime in Settings → Subscription within the Service.

4.4 Refunds

  • Trial: No charge if you cancel before the trial ends.
  • Monthly: Generally non-refundable once the period has begun. You retain access through the end of the paid period after cancellation.
  • Annual: Within 14 days of initial purchase or renewal, you may request a full refund by emailing info@govitamins.app. After 14 days, annual subscriptions are non-refundable except where required by law.
  • EU/UK consumers have statutory withdrawal rights as described in Section 4.5.

4.5 EU/UK Consumer Withdrawal Right

If you are a consumer in the EU or UK, you have the right to withdraw from the contract within 14 days without giving a reason. By starting to use paid features during the trial or paid period, you expressly request that we begin performance before the withdrawal period ends and acknowledge that you lose your right of withdrawal once the Service has been fully performed.

4.6 Failed Payments

If a payment fails, we may retry the charge, suspend access to paid features, and ultimately downgrade or terminate the account if payment is not received.

4.7 Taxes

You are responsible for any sales, use, value-added, or similar taxes associated with your subscription. Where required, we will collect and remit these taxes through our payment processor.


5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Provide false information about yourself or your child.
  • Create an account on behalf of someone else without authorization.
  • Attempt to access another user's account, child data, or any non-public area of the Service.
  • Reverse-engineer, decompile, scrape, or extract data from the Service except as permitted by law.
  • Interfere with, disrupt, or place undue load on the Service or its infrastructure.
  • Use the Service to develop a competing product.
  • Use the AI features to generate harmful, defamatory, deceptive, or illegal content.
  • Upload viruses, malware, or content that infringes third-party rights.

We reserve the right to remove content and suspend or terminate accounts that violate these rules.


6. Your Content and License to Us

You retain ownership of the content you submit ("Your Content"), including child profile information, meal logs, photos of food, voice recordings, and messages to the AI.

By submitting Your Content, you grant Go Vitamins a worldwide, non-exclusive, royalty-free license to use, store, process, reproduce, display, and create derivative works from Your Content solely to operate, provide, secure, and improve the Service. This license ends when you delete Your Content or your account, except for:

  • Copies in routine backups (purged within 90 days).
  • Aggregated and de-identified data used for analytics and research.
  • Records required by law.

You represent and warrant that you have all rights necessary to submit Your Content and that doing so does not violate the rights of any third party.

You may not upload photos that contain identifiable images of your child's face. Photos should be of food only. We may automatically detect and reject photos that appear to contain identifiable images of minors.


7. AI Features and Limitations

The Service includes AI-generated content, including the Lookie AI nutritionist chat, meal parsing from photos and voice, the Child Acceptance Engine, nutrition scoring, and personalized suggestions.

You acknowledge that:

  • AI output may be incorrect, incomplete, or out of date.
  • AI output is not professional medical or nutritional advice.
  • You should independently verify any allergen, ingredient, or safety-relevant information before acting on it.
  • You should not share medical record numbers, government identifiers, or other sensitive identifiers in chat.
  • We may use anonymized prompts and outputs to evaluate and improve the Service, but, under our agreement with our AI provider, your inputs and outputs are not used to train their underlying models.

8. Intellectual Property

The Service, including its design, code, content, trademarks, and the AI nutritionist persona "Lookie," is owned by OpenAir LLC or its licensors and protected by U.S. and international intellectual property laws. Except for Your Content, all rights are reserved.

You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

You may not use our trademarks, name, or logo without our prior written permission.


9. Third-Party Services and Links

The Service integrates with or links to third-party services such as Stripe (payments), Supabase (database), Anthropic (AI), Trader Joe's, Whole Foods Market, and other retailers. We are not responsible for the content, products, terms, or privacy practices of these third parties. Your interactions with them are governed by their own terms.

Product information displayed in the Service (prices, availability, ingredients) is provided for convenience and may be inaccurate or out of date. Always confirm details at the point of purchase.


10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free.
  • AI output, nutrition scores, or product information will be accurate or current.
  • The Service will meet your specific requirements or expectations.
  • Defects will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply to the maximum extent permitted by law.


11. Children's Privacy

Go Vitamins is not directed to children. Children do not have accounts and do not interact with the Service. Parents and legal guardians may enter information about their children into the Service under the parental-consent framework described in our Privacy Policy.

When you provide information about your child, you represent and warrant that you are the parent or legal guardian and that you have authority to provide that information and to grant the licenses described in Section 6.

You have the right to review, request deletion of, and refuse further collection of your child's information at any time. See the Privacy Policy and Section 12 below.


12. Account Termination and Data Deletion

12.1 Termination by You

You may delete your account at any time from Settings → Delete Account in the Service. Deletion will:

  • Permanently remove your account and all associated child profiles, meal logs, AI conversations, and preferences from our active systems within 30 days.
  • Purge residual copies from encrypted backups within 90 days.
  • End your right to access paid features as of the deletion date. We do not provide refunds for unused portions of monthly subscriptions; annual subscriptions are refundable under the conditions in Section 4.4.

You may export your data prior to deletion via Settings → Export My Data.

12.2 Termination by Us

We may suspend or terminate your account at any time for material breach of these Terms, suspected fraud, abusive behavior, legal compliance, or if continued operation of your account poses a risk to the Service or other users. Where reasonable and legally permitted, we will give notice and an opportunity to cure.

12.3 Survival

The following sections survive termination: 1 (Medical Disclaimer), 6 (limited license already exercised), 8 (Intellectual Property), 10 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), 15 (Dispute Resolution), 16 (Governing Law), and 18 (General).


13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Go Vitamins, OpenAir LLC, and our officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of the Service.
  • Our aggregate liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD $100.
  • These limitations apply whether the claim is based on contract, tort, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under applicable law.


14. Indemnification

You agree to indemnify, defend, and hold harmless OpenAir LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party right, including any intellectual property or privacy right.
  • Any decision you make about your child's nutrition, health, or care based in whole or part on the Service.

15. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

15.1 Informal Resolution

Before filing a formal claim, you and Go Vitamins agree to try to resolve the dispute informally for at least 60 days. Send a written notice describing the dispute to info@govitamins.app.

15.2 Binding Arbitration

If we cannot resolve the dispute informally, you and Go Vitamins agree to resolve any claim arising out of or related to these Terms or the Service through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be held in Los Angeles County, California, or remotely, and will be conducted in English.

15.3 Class Action Waiver

You and Go Vitamins agree that each may bring claims only on an individual basis and not as a plaintiff or class member in any class or representative action. Arbitration may not be consolidated with any other proceeding.

15.4 Exceptions

Either party may bring an individual action in small-claims court. Either party may seek injunctive or equitable relief in court for infringement of intellectual property rights.

15.5 Opt-Out

You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing info@govitamins.app with the subject "Arbitration Opt-Out" and including your name and account email.


16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Subject to Section 15, the state and federal courts located in Los Angeles County, California, have exclusive jurisdiction over any disputes not subject to arbitration.

If you are a consumer residing in the EU, UK, or another jurisdiction with mandatory consumer-protection laws, you have the benefit of mandatory provisions of the law of your country of residence.


17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email and/or by a prominent notice in the Service at least 14 days before the changes take effect. The "Last Updated" date indicates when these Terms were last revised. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service and may delete your account.


18. General

  • Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Go Vitamins regarding the Service and supersede prior agreements.
  • No Waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
  • Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Force Majeure. We are not liable for failures or delays caused by events beyond our reasonable control.
  • Notices. We will send legal notices to the email address associated with your account. You will send legal notices to info@govitamins.app and by certified mail to the address in Section 19.
  • Headings. Section headings are for convenience and do not affect interpretation.
